RIDE THE WAVE PTY LTD - ABN 26166132065 (trading as RAFFLE BUZZ) is a for-profit organisation authorised to conduct raffles on behalf of our charity partners. Charity partners include registered charities, not-for-profit organisations and agents working on the behalf of the charity/not-for-profit organisations. Ride The Wave Pty Ltd has a contract with each of our charity partners that allows us to raise money and awareness via raffles, both online and in a live setting.

We offer users of the platform the opportunity to support charities through the purchase of raffle tickets and offer the ability to use these tickets to participate in raffle events. These terms and conditions apply to all users of the RaffleBuzz platform, including charity partners and users who purchase tickets and participate in raffles.

Ride The Wave Pty Ltd reserves the right to change the terms and conditions outlined below If we feel it could benefit entrants or alternately be of no detriment to participants. Subject to obtaining approval from regulatory authorities, we may place a notification of these changes on our website.

By using this site, purchasing raffle tickets and participating in raffle events through the “RaffleBuzz” platform www.rafflebuzz.com.au you hereby agree to adhere to the terms and conditions of the site. With regards to online raffles, RIDE THE WAVE PTY LTD will accept all liability with regards to adherence to Australian and Queensland laws and guidelines, including compliance with OLGR (Office of Liquor and Gaming Regulation) and ACL (Australian Consumer Laws). Nothing in these terms affects your rights under Australian Consumer Law.

Ride The Wave Pty Ltd reserves the right, at any time, and at our sole discretion to disqualify any user who we believe has breached any of these terms and conditions, or we believe has engaged in any unlawful or improper conduct that may jeopardise the fair and proper conduct of the raffles.

By accessing and using the RaffleBuzz website, you signify acceptance of terms, conditions, notices, disclaimers and policies displayed on or accessible from the Website.

The raffles conducted on this platform are in accordance with a category 1 and category 2 games pursuant to the Charitable and Non-Profit Gaming Act 1999 (Qld)

Purchases made through the RaffleBuzz platform are non-refundable and non-disputable. We retain the right to assess written refund claims on a case-by-case basis and reserve the right to refuse such claims. If there has been unauthorised use of a credit card, we will comply with all investigations and will work with the parties involved to come to a resolution. All written refund requests, of any nature, must be submitted to admin@rafflebuzz.com.au

We do not guarantee the accuracy of any information presented by any third party through our website, including the websites and content of our charity partners. Any links to websites and third parties are not under the control of us, and we have no influence over the nature, content and availability of these sites. The inclusions of links does not imply recommendation or endorsements of the views expressed within these sites. We do not endorse User Content.

We make every effort to keep the platform running a smooth as possible, but take no responsibility and will not be liable for any issues that arise due to the website being temporarily unavailable due to technical issues that are beyond our control. We do not guarantee continuous accessibility, uninterrupted operation or any particular standard of performance.

If for any reason the raffles are not capable of running as planned, including but not limited to tampering and unauthorised intervention, fraud or any technical difficulties/equipment malfunction or any other causes beyond our control, we reserve the right to take any action that may be available to cancel, terminate, modify or suspend the raffle, subject to state regulation.

We have the right to terminate, suspend or delete any user account at any time for any reason, or no reason. It is our policy not to comment on any reason for termination and we have no obligation to provide you with a reason for termination.

The laws of Queensland apply to the RaffleBuzz website, the service provided and our terms and conditions and users irrevocably submit to the non-exclusive jurisdiction of the Queensland courts in connection with any aspect of the Rafflebuzz website and service. If any disputes arise of a legal nature, we encourage you to contact us in the first instance as most can be resolved without the involvement of a court or arbitrator. These terms and conditions, and relationship between you and Ride The Wave Pty Ltd shall be governed in all respects by the laws of Queensland. We will not become involved in any legal disputes between users and third parties.

We will make every effort to substantiate our Charity Partners are registered and operating lawfully, but accept no liability whatsoever for any actions or fraudulent activities in accordance with state and federal laws. It is the responsibility of our Charity Partners to ensure they meet the requirements of Government legislation in their state.

To purchase tickets you must be at least 18 years of age and a resident of Queensland, New South Wales, Australian Capital Territory, Victoria, Tasmania, Northern Territory, South Australia and Western Australia.

Minimum target amounts will be advised for each prize, and determined by our charity partners however the total prize pool may exceed this to a total in adherence with government regulations.

If a prize is not available for any reason, Ride The Wave Pty Ltd will reach an agreement with the relevant winner to determine a substitute prize to similar or greater value of the unavailable prize.

Actual value of prizes may not be displayed on the site, instead the minimum target amount will be determined by our charity partners and displayed accordingly.

Other costs associated with the prizes, including express shipping and insurance are the responsibility of the winners.

Winners will have 3 months from the time of the draw to claim their prize.

We are not liable for the quality or distribution of donated items and this will have to be raised with the charity organisation you are supporting.

This is a game of chance, and odds are increased when a higher percentage of tickets are purchased.

Winning entries are drawn randomly by computer based on all eligible entries at the moment the raffle timer has finished, or when our Charity Partner chooses to draw the winner. The winning person will be displayed at this time and a win/loss will be recorded for all participants in the raffle.

It is the responsibility of the winner to claim the prize and register their delivery details to do so.

Prizes cannot be transferable, assigned to another person, or redeemable for cash.

All prizes will be drawn in Australian Eastern Standard Time.

A receipt number will be available for all purchases, and a log of all entries into raffles will be available.

Raffle proceeds, less the nominated service fee charged by Raise Now Pty Ltd, will be forwarded to our Charity Partners bank account within 2 working days of the raffle being drawn.

Raffle tickets that have been purchased and not used in a particular raffle event may be re-used in a future event, or donated to a chosen charity.

Ride The Wave Pty Ltd will facilitate delivery of prizes to the winners registered address, with the only exception being donated prizes to our charity partners. In this instance, the delivery address will be provided to the Charity Partner and they will organise this delivery. Ride The Wave Pty Ltd will not be liable for the non-receipt of any donated prizes for any reason.

The accessibility and operation of the RaffleBuzz website relies on internet technologies outside of our control. We accept no responsibility for any issue that may arise due to a technical malfunction of a computer system, software or internet difficulty, including the inability to enter into raffles. We accept no responsibility for late, lost or misdirected raffle entries.

If we are prevented from or delayed in performing an obligation by Force Majeure or an Act of God then the obligation is suspended during, but not longer than the period that the issue continues and any further period that is reasonable in the circumstances. This is defined as any event beyond the reasonable control of the RaffleBuzz administrators, which occurs without fault or negligence.

No part of this website may be republished, reproduced, downloaded, displayed, distributed, posted, transmitted, or sold in any form, or by any means in whole or in part without prior permission from us. Users of this website may not reproduce or reuse, for any commercial purpose whatsoever, any aspect of the website content.

All graphics on this site are the property of Ride The Wave Pty Ltd and may not be copied or replicated in any way without prior consent.

All content (texts, trademarks, illustrations, photos, graphics, files, designs, arrangements, systems and processes etc) for conducting raffles on the site are the intellectual property of Ride The Wave Pty Ltd and protected by the governing laws surrounding intellectual property. You agree to not change, translate or otherwise create derivative works of the RaffleBuzz service.

You allow us to use User Content. By agreeing to these terms and conditions you grant Ride The Wave Pty Ltd a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, sublicensable, transferable, right to use, exercise, commercialize and exploit the copyright, publicity, trademark and database rights with respect to User Content.

Be truthful and do not post information you know is misleading, inaccurate, deceptive, defamatory, offensive, untrue, obscene, racist or fraudulent.

You may not bypass any measures, reverse engineer or take apart any aspect of the Service, or take any actions to gain unauthorized access to any system, data or passwords. You may not distribute software viruses, or anything else designed to interfere with the software, hardware or equipment on the Site or access the site through the login of any other user. You may not access the service if we have prohibited you from doing so.

We care about the wellbeing of our users and promote responsible gambling practices.

We do not extend credit, or loan money to customers in order to purchase raffle tickets.

Ticket purchasers who believe they have a gambling problem or overextended financially will be given an opportunity to appeal in order to amend or cancel their participation.

Credit card payment processing services for RaffleBuzz are provided by Stripe and may incur costs for the transaction. By purchasing raffle tickets through Stripe you are subject to the Stripe Connected Account agreement, which includes the Stripe Terms of Service.

There are no fees associated with creating an account on the Site for both users and Charity Partners. Ride The Wave Pty Ltd will take a predetermined percentage of the total prize pool for each raffle to cover administration fees and delivery of the item. All donated items will have a fixed fee and a smaller percentage of the total prize pool. We reserve the right to offer premium services at cost, and negotiate different rates with our Charity Partners on a case-by-case basis.
